Ferno may, by giving notice to the Customer at any time before delivery, increase the price of the Goods to reflect any increase in the cost of the Goods that is due to: Emergency response teams count on FERNO products for durable, lightweight extraction and evacuation solutions. Our emergency stretchers are manufactured using the strongest, lightest materials possible, with versatility in mind. Any variation to the Contract, including the introduction of any additional terms and conditions, shall only be binding when agreed in writing and signed by the Customer. A person who is not a party to the Contract shall not have any rights under or in connection with it.

FERNO manufactures two Scoop stretcher models that help improve patient outcomes and keep caregivers safe. Both are adjustable, lightweight, and include three restraint straps. Their two-part design eliminates the need for logroll manoeuvres, helping prevent spinal injury exacerbation. Whatever types of stretchers your organization needs, such as rescue stretchers, litters, emergency stretchers, or stretcher chairs, FERNO has the solutions you need. For over 65 years, our focus on perfecting our emergency stretcher designs has improved patient outcomes and emergency responder safety. These Conditions apply to the Contract to the exclusion of any other terms that the Customer seeks to impose or incorporate, or which are implied by trade, custom, practice or course of dealing. Any dates quoted for delivery are approximate only, and the time of delivery is not of the essence.If the Customer becomes subject to any of the events listed in Condition 7.2, or Ferno reasonably believes that the Customer is about to become subject to any of them and notifies the Customer accordingly, then, without limiting any other right or remedy available to Ferno, Ferno may cancel or suspend all further deliveries under the Contract or under any other contract between the Customer and Ferno without incurring any liability to the Customer, and all outstanding sums in respect of Goods delivered to the Customer shall become immediately due. The Strykers are easier (in my experience) for one person to control. This is important to me because commercial ambulance companies do mostly "routine" transports, which means I push my patients through more hospital corridor in one day than most emergency unit EMTs (those responding to 911 calls and taking patients into emergency departments) walk in a week. My company is too cheap to outfit its stretchers with those parcel nets on the frame either under the head or at the bottom, which means any patient belongings (remember, this is commercial transport, meaning mostly discharges or transfers, so a lot of belongings often accumulate) have to be hand-carried, which in turn means either multiple trips in and out of the hospital, or one person carries belongings while the other controls the stretcher. Ferno shall not be liable for, and the Customer shall bear in full, any increased costs arising due to a fluctuation in the rate of exchange of Sterling against any other currency. If any invalid, unenforceable or illegal provision of the Contract would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable. The price of the Goods is exclusive of the following (each of which shall be payable by the Customer to Ferno in addition to the Price for the Goods):

The provisions of this Condition shall not apply to the services of any proceedings or other documents in any legal action. Nothing in these Conditions shall limit or exclude Ferno’s liability for death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors (as applicable); fraud or fraudulent misrepresentation; or any other matter in respect of which it would be unlawful for Ferno to exclude or restrict liability.

If any amount due under this Contract is subject to VAT, sales, withholding or any other tax (other than income tax applicable to Ferno) duty, levy or tariff which has the effect of reducing the amount of money which Ferno would have been entitled to receive from the Customer or to retain under this Contract but for such tax, duty, levy or tariff the Customer will, at Ferno’s request, pay Ferno such additional sum at the rate for the time being prescribed by law for that tax, duty, levy or tariff. and in such circumstances the Customer shall be liable to pay to Ferno a handling charge equal to 20% (twenty per cent) of the gross invoice value of the Goods. Ferno (UK) Limited (Ferno), warrants Productsto be free from defects in material and workmanship for two years except as follows: Ferno shall not be liable to the Customer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit or indirect or consequential loss arising under or in connection with the Contract; andIf Ferno fails to deliver the Goods, its liability shall be limited to the costs and expenses incurred by the Customer in obtaining replacement goods of similar description and quality in the cheapest market available, less the price of the Goods. Ferno shall have no liability for any failure to deliver the Goods to the extent that such failure is caused by a Force Majeure Event or the Customer's failure to provide Ferno with adequate delivery instructions or any other instructions that are relevant to the supply of the Goods. the Customer gives notice in writing to Ferno during the warranty period within a reasonable time of discovery that some or all of the Goods do not comply with the Warranty; and Ferno’s total liability to the Customer in respect of all other losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the price of the Goods. the Customer makes any further use of such Goods after giving notice in accordance with Condition 4.1; or If any court or competent authority finds that any provision of the Contract (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of the Contract shall not be affected.
